1. Introduction and Scope

This Legal Notice and Disclaimer (the "Notice") governs your access to and use of the website, mobile pages, applications, and all related content and services operated by My Store - entity (the "Company", "we", "us" or "our") under the brand name My Store (the "Store"). The Store sells and distributes apparel, footwear, sports bags and related accessories (collectively, the "Products").

By accessing, browsing, registering on, or purchasing from the Store, you acknowledge that you have read, understood and agreed to be bound by this Notice. If you do not agree, you must discontinue use of the Store.

This Notice should be read together with our Terms of Service, Privacy Policy, Shipping Policy and Return and Refund Policy (collectively, the "Store Policies"). Where a specific Store Policy addresses a matter in greater detail, that policy prevails to the extent of the inconsistency. Nothing in this Notice limits any right that cannot be limited under applicable consumer protection law.

2. Intellectual Property Rights

All content made available through the Store, including but not limited to trademarks, trade names, logos, product photographs, model and lifestyle images, product descriptions, sizing charts, graphic elements, page layouts, software and source code (collectively, the "Content"), is owned by the Company or its licensors and is protected by copyright, trademark and other intellectual property laws.

You may access and use the Content solely for personal, non-commercial purposes in connection with browsing and purchasing Products. You may not, without our prior written consent:

copy, reproduce, republish, upload, post, transmit or distribute any Content;

use automated scripts, crawlers, scrapers or data-mining tools to extract Content, prices or product data;

use our trademarks, trade names or logos in any manner likely to cause confusion, or in any way that disparages or discredits the Company;

remove, obscure or alter any copyright, trademark or other proprietary notice; or

frame, mirror or otherwise simulate the appearance of the Store on any other website.

Third-party trademarks, brand names and product names that appear on the Store are the property of their respective owners and are used solely for identification purposes. Their appearance does not indicate any affiliation, sponsorship or endorsement.

3. Product Information and Descriptions

3.1 Accuracy of Descriptions

We endeavor to describe Products accurately, including material composition, construction, fit, care instructions and measurements. Product information is compiled from manufacturer, supplier and production records. We do not warrant that descriptions, specifications or other Content are error-free, complete or current.

3.2 Colour and Image Variation

Colours and finishes of apparel, footwear and bags may appear differently depending on monitor settings, lighting conditions and device calibration. Photographs on the Store are for illustrative purposes; model images, styled images and flat-lay images may show accessories, undergarments or props that are not included with the Product. Minor variation in shade, texture, print placement and surface finish is inherent to textile and leather goods and does not constitute a defect.

3.3 Sizing and Fit

Sizing information, measurement tables and fit guidance are provided for reference only. Garment measurements are taken manually and may vary within a reasonable tolerance. Individual body shape, layering, fabric elasticity and washing behaviour affect how a Product fits. Where fit is material to your decision, you should review the sizing chart, product measurements and care instructions before ordering, and use the Return and Refund Policy where the item does not suit you.

3.4 Bags, Footwear and Load-Bearing Use

Capacity, weight ratings and structural descriptions for sports bags and footwear describe intended everyday and athletic use under normal conditions. Products are not certified for industrial, safety-critical, medical, climbing, rescue or other specialized applications unless expressly stated on the product page. You are responsible for using each Product in the manner for which it is designed and for inspecting it before each use.

3.5 No Professional Advice

Content on the Store, including guidance on material selection, foot support, training use or care routines, is general information only. It is not medical, podiatric, physiotherapy, safety or other professional advice and must not be relied on as a substitute for consultation with a qualified professional.

3.6 Corrections and Availability

We reserve the right to correct errors, inaccuracies or omissions in Product information and to change or discontinue Products, colours, sizes and collections at any time without prior notice. Such changes do not retroactively alter the terms of an order already accepted and paid for, except where a correction is required by law or where the parties agree otherwise.

4. Pricing, Availability and Orders

All prices are displayed in the currency shown at checkout and, unless otherwise stated, exclude shipping charges, duties, taxes and fees that may apply in your jurisdiction. The price, availability and promotional terms shown at the checkout page govern the transaction.

We reserve the right to refuse or cancel any order, in whole or in part, where:

a Product is mispriced or listed with incorrect information due to error;

stock is unavailable or insufficient to fulfil the order;

the order appears to result from fraud, unauthorized use of a payment method, automated bulk purchasing or resale activity; or

fulfilment would breach applicable law, sanctions or our Store Policies.

Where an order is cancelled under this section before shipment, we will refund the amount actually paid for the affected items in accordance with the Return and Refund Policy. A confirmation page or auto-generated email acknowledging receipt of an order does not constitute acceptance; acceptance occurs when the order is dispatched or when we otherwise expressly confirm it.

Promotional offers, discount codes, bundle pricing and free-shipping thresholds are subject to the stated conditions, time limits and stock limits, may not be combined unless stated, and may be withdrawn or amended before an order is placed.

5. Shipping, Returns and Exchanges

Shipping timescales, delivery methods, customs and import obligations, return windows, exchange conditions and refund procedures are set out in our Shipping Policy and Return and Refund Policy, which form part of this Notice by reference. Statements in this Notice do not restrict or exclude any statutory consumer right, including rights relating to goods that are faulty, not as described or unfit for purpose.

6. Acceptable Use

You agree not to use the Store:

for any unlawful purpose or in breach of applicable law;

to interfere with, disrupt, overload or attempt to gain unauthorized access to the Store, its servers, networks or security measures;

to introduce malware, viruses or any other harmful code or material;

to impersonate the Company, its staff or another user, or to misrepresent an affiliation;

to submit false, misleading or manipulated reviews, ratings or feedback; or

to purchase Products for the purpose of misrepresenting them as authentic goods of another brand, or to infringe the intellectual property or other rights of any person.

We may suspend or terminate access, cancel pending orders and pursue available remedies where we reasonably believe a breach of this section has occurred.

7. Third-Party Links and Services

The Store may link to or integrate third-party websites, payment processors, logistics providers, review platforms, analytics tools and social media services. Those services are operated by independent third parties and are governed by their own terms and privacy policies. We do not control and are not responsible for their content, availability, security or practices, and a link does not imply endorsement.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Store and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Store will be uninterrupted, secure, error-free or free of harmful components, or that any information obtained through it is accurate or reliable.

Some jurisdictions do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you. In that case, the excluded warranties are limited to the minimum extent permitted by law, and nothing in this Notice excludes a warranty that cannot lawfully be excluded.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its officers, employees, agents and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or anticipated savings, arising out of or relating to your use of, or inability to use, the Store or the Products, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.

To the same extent, our aggregate liability arising out of or relating to any Product shall not exceed the total amount you actually paid for that Product.

Nothing in this Notice excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any statutory consumer guarantee or right that applicable law does not permit the parties to waive.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the Company and its officers, employees and agents from any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees and costs, arising out of or relating to your breach of this Notice, your misuse of the Store or the Products, or your infringement of the rights of any third party. This obligation does not apply to the extent the claim arises from our own wrongful act.

11. Privacy and Data Protection

Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy, which is incorporated into this Notice by reference. By using the Store you acknowledge that you have reviewed that policy.

12. Governing Law and Dispute Resolution

This Notice and any dispute or claim arising out of or in connection with it or the Store shall be governed by the laws of the State of California, United States, without regard to conflict of law principles and without prejudice to any mandatory consumer protection rules of your place of residence.

Before commencing formal proceedings, you agree to first contact us at rickylambert3666@outlook.com with a written description of the issue so that the parties may attempt to resolve it in good faith within a reasonable period. If the matter is not resolved, the parties submit to the exclusive jurisdiction of the competent courts of the State of California, United States. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief, or from bringing proceedings in a forum whose jurisdiction cannot lawfully be excluded.

13. Changes to This Notice

We may amend this Notice at any time to reflect changes in our Products, operations, technology or legal obligations. The revised Notice will be published on this page with an updated effective date. Material changes will be communicated through the Store or by other reasonable means before they take effect where required by law. Continued use of the Store after the effective date constitutes acceptance of the revised Notice.
